Probate & Administration Applications

To probate a will is to have The Supreme Court of British Columbia confirm its validity. Not all wills need to be probated by a court. Financial institutions and other parties holding assets on behalf of your estate may require a will be probated before those assets are released.

No will? No executor?

You can apply to be the administrator (the Court-appointed executor). Usually this application is made

  • in the absence of a will,
  • when no executor is identified in the will,
  • the original executor died and there is no replacement name,
  • when the executor cannot or will not take on that responsibility.
